Legal Update From Labor Attorney Jonathan Judge
Staying on top of new legislation couldn’t be easier for EAOC members, since we have Labor Attorney Jonathan Judge in our roster!
Jonathan Judge, Partner with Atkinson, Andelson, Loya, Ruud & Romo, advises employers in various labor and employment law matters, including drug testing, mass layoffs (WARN), disparate impact analysis, immigration compliance, trade secrets, privacy, technology in the workplace, piece rate compensation, municipal and state sick leave, local, state and federal minimum wage law, and the Patient Protection and Affordable Care Act.
At this week’s morning meeting, members received details on California’s Legislative Updates for 2026. Some key takeaways were:
SB 513: Personnel Records Inspection Rights
Expands employee rights to inspect and receive copies of their personnel records to include documents relating to:
–Employee’s performance
–Grievances
–Education
–Training
Education and training records must include:
–Employee’s name
–Name of training provider
–Duration and date
–Core competencies
–Resulting certification or qualification
SB 590: Paid Family Leave for Designated Family Member
• Expands PFL’s eligibility for benefits to include individuals who take time off to care for a seriously ill designated person
• “Designated person” is defined as, “any individual related by blood or whose association with the employee is equivalent to a family relationship.”
• Employees must provide proof of relationship along with declaration under penalty of perjury
